Terms and Conditions
These terms cover the use of this website and every purchase, sale or sourcing request agreed with HYPA. Please read them before you enquire. Last updated 11 September 2026.
1. About these terms
HYPA International Pty Ltd (ACN 655 066 069), trading as HYPA, is a registered second-hand dealer in Victoria (licence SHD-0018017) located at 20 Queens Rd, Melbourne VIC 3004. In these terms “we”, “us” and “HYPA” mean HYPA International Pty Ltd, and “you” means the person dealing with us.
These terms apply to your use of this website and to any contract we make with you for the sale, purchase or sourcing of a watch. They are written for consumers. If you are dealing with us in the course of a business, ask us for our business terms. Nothing in these terms excludes or limits any right you have under the Australian Consumer Law that cannot be excluded.
You must be 18 years of age or over to buy from or sell to us.
2. Using this website
The catalogue on this website is a reference to the models and references we deal in. It is not a list of stock. A page that shows “Price on enquiry” is an invitation to ask, not an offer to sell, and a watch shown with a price is subject to availability until we have confirmed a sale to you in writing.
Specifications, dimensions, calibre details and production dates are compiled from manufacturer publications and other sources available to us and are provided in good faith for reference. Photographs are illustrative and colours may vary with your screen. Where a piece is offered for sale, its own description and photographs take precedence over the reference page.
HYPA is an independent dealer and is not affiliated with, endorsed by or an authorised retailer of any manufacturer named on this website. Brand and model names are the trademarks of their owners and are used only to identify the watches.
The text, photographs and design of this website belong to us or our licensors and may not be reproduced without our written permission, other than for your own personal, non-commercial use.
3. Buying a watch from us
A purchase begins with an enquiry. We will confirm availability, price and the details of the piece, and a contract is formed only when we confirm your order in writing, normally by email, after payment terms have been agreed. Any watch not named in that confirmation is not part of the contract.
Prices are in Australian dollars and include GST unless stated otherwise. Delivery outside Melbourne is quoted separately. A quoted price is held for the period stated in the quote, or for five working days if no period is stated. If we discover that a price was stated in error, we will tell you and give you the choice of proceeding at the correct price or cancelling for a full refund of anything paid.
We accept payment by bank transfer only, including PayID and Osko. We do not accept cheques or card payments. Payment from outside Australia must be made by international bank transfer. We must receive full and cleared funds before a watch is dispatched or collected. Bank charges on international transfers are your responsibility, and we do not accept liability for exchange-rate movements.
If we agree to hold a watch against a deposit, the balance is due within 14 days unless we agree otherwise. If the balance is not paid in that time we may cancel the sale after giving you three days’ notice, and we will refund the deposit within 14 days unless clause 10 applies.
If you offer a watch in part exchange, we will value it before confirming your order and the selling terms in clause 8 apply to it. Your part-exchanged watch becomes our property when the order is confirmed.
4. Delivery and collection
Within Australia we deliver by insured courier, and a signature is required on delivery. Outside Australia we deliver by insured international courier. Any import duty, tax or customs charge in the destination country is your responsibility, may be payable before the courier releases the watch, and cannot be refunded by us. Customs inspections can delay delivery and are outside our control.
You may collect in person from our premises by appointment. If you arrange your own courier, delivery is complete when the courier collects the watch and we are not responsible for it after that point.
Risk in the watch passes to you when it is delivered to your nominated address or collected. Ownership passes to you only when we have received payment in full and cleared funds; until then you hold the watch on our behalf.
5. Condition, descriptions and paperwork
Unless described as new or unworn, every watch we sell is pre-owned and may show signs of previous wear, such as light marks, small scratches and hairline abrasions. These are normal for a pre-owned watch and are reflected in our description of the piece. If you want more detail before you buy, ask us for close-up photographs, video or further inspection notes, and we will provide them.
Descriptions reflect the condition of the watch when it was listed. A stated year of manufacture is our best estimate from serial ranges and manufacturer references unless the paperwork confirms it. Where a watch contains any non-manufacturer component, such as a replacement bezel, dial, hands, strap or bracelet, we will tell you before you buy. A non-manufacturer strap may be fitted to a watch.
“Box and papers” or “full set” means the original warranty card or certificate and the original presentation box, together with any manuals and accessories we state are included. The paperwork identifies the authorised retailer of original sale, the serial number and the date of sale. Service papers and user manuals are not paperwork for this purpose. We cannot guarantee that boxes or packaging are original unless we say so.
Vintage, early-generation and collectible references may run outside modern manufacturer tolerances, contain aged components, show patina and need gentler handling and more frequent servicing. These characteristics are normal for older watches and form part of their character.
6. Water resistance
Water resistant does not mean waterproof. A rating in metres or bars describes static laboratory pressure, not real-world use; a watch rated 30 metres will withstand only minor splashes, and a 100-metre rating does not make a watch suitable for use at 100 metres. Water resistance declines with age and seal wear, and a pre-owned watch cannot be guaranteed to meet its original rating. We do not recommend exposing a pre-owned watch to water unless its water resistance has been tested after purchase. Water damage is not a defect in the watch, whatever the stated rating. Keep crowns and pushers screwed down or pushed in, never operate a pusher underwater, and rinse the watch in fresh water after exposure to salt or chlorinated water.
7. Warranty
Where a watch is still covered by the manufacturer’s warranty, that warranty is governed by the manufacturer’s own terms, which you can read in the paperwork or on the manufacturer’s website. We do not alter or extend it. If a claim arises we may help you send the watch to the manufacturer or an authorised service centre, and the manufacturer’s process and timeframes then apply.
A manufacturer’s warranty is in addition to the consumer guarantees under the Australian Consumer Law, which apply whether or not a manufacturer’s warranty exists. Those guarantees do not cover normal wear and tear, accidental damage, misuse, water damage, or work carried out on the watch by a third party.
8. Selling your watch to us
We buy watches valued at $20,000 AUD and above. A sale to us begins with an enquiry describing the watch, ideally with photographs. Any figure we give from a description or photographs is an indicative valuation, not an offer. Our firm offer is made after we have received the watch and physically inspected and authenticated it, and confirmed its condition and details. If the watch is not as described, we will tell you and either revise the offer or return the watch at your cost.
By offering a watch to us you confirm that you own it outright, that it is not subject to any finance, security interest or claim by another person, that it is not stolen or counterfeit to the best of your knowledge, and that you are entitled to sell it.
As a licensed second-hand dealer we are required by Victorian law to record and retain your identification details for every purchase, and we may be required to hold a purchased watch for a period before it is resold. We will not complete a purchase until this identification has been provided.
Payment is made by bank transfer once the inspection is complete and the purchase is agreed. Ownership of the watch passes to us when we have paid you.
9. Sourcing a watch
If you ask us to find a watch, we will confirm what we are looking for and, when we locate a suitable piece, describe and price it to you. You are under no obligation until you confirm the purchase in writing, at which point clauses 3 to 7 apply. If we ask for a deposit to secure a piece on your behalf, we will tell you the terms of that deposit before you pay it.
10. Faulty goods, cancellation and refunds
Our watches come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
If you believe a watch is faulty, tell us as soon as reasonably possible at contact@hypa.international. We will ask you to return the watch to us, securely packed and insured, for inspection by us or by an authorised watchmaker. It remains your responsibility until we receive it. If a defect is confirmed we will repair, replace or refund in accordance with the Australian Consumer Law. If the inspection finds wear and tear, misuse, impact, water damage, unauthorised work by a third party, or that the watch is performing within expected tolerances, the watch will be returned to you and the assessment and postage costs are yours.
Other than where the Australian Consumer Law requires it, we do not offer refunds for a change of mind. You may cancel an order before the watch is dispatched or collected, and we will refund what you have paid within five working days unless clause 11 applies. Where a refund is agreed, the watch must be returned in the condition in which you received it with everything supplied with it; if anything is missing, damaged or altered, we may reduce a refund that is not required by the Australian Consumer Law. Refunds are made by the original payment method in Australian dollars, less any bank charges on an international transfer.
11. Verification and fraud prevention
We may carry out identity, payment and ownership checks before accepting an order, releasing a watch or making a payment, and we may delay or decline a transaction, or withhold a refund, while those checks are completed or where we reasonably suspect fraud. Where a suspected fraud is reported to the authorities, we may retain funds and goods as they require.
12. Our liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee or other right that cannot lawfully be excluded. To the extent the law allows, our total liability to you in connection with a watch is limited to the price you paid for it, and we are not liable for loss of profit, loss of opportunity or any indirect or consequential loss.
We are not responsible for a failure or delay caused by events outside our reasonable control, including courier and customs delays, manufacturer and service-centre lead times, strikes, failures of banking or telecommunications systems and natural events. We will tell you if such an event affects your order and, where a delay becomes substantial, you may cancel the order and receive a refund of what you have paid.
13. Privacy
Personal information is handled in accordance with our Privacy Policy.
14. Governing law
These terms and any contract between us are governed by the laws of Victoria, Australia, and any dispute must be brought exclusively before the courts of Victoria. If you are a purchaser based in the United States and bring a claim in a United States court, you agree to resolve the dispute individually and not as part of a class action, and to waive any right to a jury trial.
